Javier’s Sabor Mexicano, located at 8 W. Miner Street, has submitted an application for outdoor dining on the public sidewalk along Miner Street. The Village Code permits the use of public sidewalks for outdoor eating cafes subject to certain criteria, including the entering into a License Agreement with the Village for the use of the public property. Javier’s previous license to utilize the sidewalk for outdoor dining expired in fall of 2019, and the business desires to enter into a new 5-year agreement to continue using the public sidewalk. In the event that alcoholic beverages are to be served on the public sidewalk, the Village’s process requires review at a Committee-of-the-Whole meeting and subsequent approval by the Village Board. Since Javier’s has previously appeared before the Committee-of-the-Whole for service of liquor in their outdoor dining area, and no changes are proposed to the scope of the previously approved outdoor dining area, all that is required is an appearance before the Village Board for approval of the new license agreement. Javier's has executed the new 5-year License Agreement.
Javier's proposal for use of the public sidewalk is consistent with the Village's requirements for an outdoor dining area. Javier’s is proposing a fence with planters along Miner Street to delineate their outdoor eating area.
RECOMMENDATION
It is recommended that a Resolution Approving a License Agreement for an outdoor eating area at Javier's Sabor Mexicano Restaurant, located at 8 W Miner Street, be approved.
