The attached ordinance contains several changes to the Municipal Code. These changes are being proposed as part of the implementation of DACRA. As DACRA will send out all notices and determinations, amendments are necessary to ensure consistency of process. Additionally, the time frame for subsequent fines needed to be changed, as all tickets will automatically be assigned a hearing date.
Utilizing DACRA, all tickets for administrative adjudication will be assigned a hearing date upon issuance of the ticket, which is not what happens now. Once issued, depending on the ticket, the Respondent can prove compliance, pay the ticket, have the ticket adjudicated by mail, or appear on the hearing date. If the ticket is not resolved in any of those ways, a 30% penalty will be attached to any fine and the ticket will be closed out. If the Respondent satisfactorily proves compliance or receives a determination from the Hearing Officer, the ticket will be resolved that way.
Recommendation
It is recommended that the Village Board adopt the attached Ordinance Amending the Municipal Code of the Village of Arlington Heights.
