The Village and the Owner at 1401 West Palatine Road have negotiated an agreement to resolve the Village’s Complaint filed with the Circuit Court in December, 2021, related to Code violations involving a dilapidated unoccupied single-family residence along with several accessory structures on the owner’s property.

In a Consent Decree to be entered with the Court, the Owner authorizes the Village to demolish the structures, remediate the property, and file a lien for related expenses, with the Village waiving certain litigation costs and delaying foreclosure of the lien for expenses incurred.

The attached Resolution Approving the Consent Decree will allow the Village to move forward in bringing the property into compliance with the Code.

RECOMMENDATION

It is recommended that a Resolution Approving a Consent Decree for the property at 1401 West Palatine Road, be approved.
