The proposed improvements for the US Route 14 & Wilke Road Intersection require temporary and permanent easements from several property owners. All temporary easements had been agreed to by the respective property owners and will be presented to the Village Board for formal approval at a later date. The permanent easement necessary from Union Pacific Railroad was agreed to by all parties and formally approved by the Illinois Commerce Commission earlier this year. The remaining permanent easement that is required for this project is from the Arlington Park Racetrack. The formal offer of $46,600 for the permanent easement from Arlington Park was presented over a year ago, and had not been executed by Arlington Park. The Illinois Department of Transportation (IDOT), Bureau of Land Acquisition, began condemnation proceedings earlier this summer, and an “Order Fixing Preliminary Just Compensation” was filed with the Circuit Court of Cook County on September 2, 2014. As part of this order, the Village of Arlington Heights is required by IDOT to deposit a check in the amount of $46,600, the amount constituting preliminary just compensation, with the Cook County Treasurer within 90 days of September 2, 2014.
RECOMMENDATION:
It is recommended that the Village Board authorize the disbursement of $46,600, to be deposited with the Cook County Treasurer. Funding is available in account number 401-5001-571-50-30 (SG0802).
