Resolution Approving a Settlement Agreement and Release of All Claims

Daniel and Sarah Brown have sought relief from the Village and its contactor, DiMeo Brothers, Inc. related to damages that occurred to their pool during the 2021 Greenbrier/Roanoke Stormwater Control Project. As a result of the settlement reached between all the parties the Village agrees that it will waive all permit fees for the Browns in the event that they install a new swimming pool. DiMeo Brothers will pay a settlement amount of $116,667. It should be noted that DiMeo, Inc. paid all of the Village’s legal bills on this matter.

Recommendation:

It is recommended that the Village Board approve a resolution authorizing the settlement of the case of Daniel Brown and Sara Brown v. Village of Arlington Heights, et al. and the execution of all settlement documents.
