Background

 
On October 2, 2023, the Village Board voted to direct the Village Attorney to draft an ordinance granting approval of Plan Commission application PC 22-010 (Paragon Mechanical LUV Amendment). Subsequent to the meeting, there was a significant amount of communication between the petitioner and staff in order to finalize the Ordinance. The Ordinance has now been finalized and reviewed by both staff and the petitioner, and is now ready for approval by the Village Board.

Modifications to Ordinance:

During discussion of this application, the Village Board granted an allowance to give the Village Manager the authority to extend the completion deadline for the sitework/landscape work to beyond May 31st, 2024, provided the petitioner was working in good faith to complete the site improvements. The petitioner has concerns that they will not be able to complete the work by May 31st, and accordingly, Staff agreed to extend the completion deadline to September 30, 2024, as follows:

• Completion of Sitework and Landscape Work: The Applicant must (1) obtain all required building permits for all sitework and landscape work depicted in the Plans on or before March 29, 2024, and (2) complete all sitework and landscape depicted in the Plans, to the Village’s satisfaction, no later than September 30, 2024, or a later date approved by the Village Manager in their sole discretion.

It should be noted that on December 8, 2023, Paragon Mechanical obtained a permit to allow for the proposed work and posted the landscape security bond.

Staff recommends that the Village Board approve the ordinance as drafted.
