1. Preliminary and Final Plat of Subdivision to subdivide the property into two lots.
Variations Required
A Variation from Chapter 29, Section 501(b) of the Municipal Code to waive the requirement to install a public sidewalk.
Background
The Plan Commission voted 8-0 to recommend approval, with the addition of a variation from the requirement to install public sidewalks.
Chapter 29 of the Municipal Code requires that the developer of any new subdivision is required to install all public improvements, including public sidewalks. However, the Village’s Sidewalk Policy states that sidewalks shall not be permitted in areas without sidewalks, unless the new subdivision is located along streets leading to schools or parks.
Planning staff discussed the Plan Commission’s recommendation with the Engineering Division, and have no objection to the variation to waive the sidewalk requirement. However, the Staff Development Committee feels that adding the following conditions of approval to would be appropriate for this subdivision:
1. For pedestrian safety, accessible sidewalk ramps shall be installed at the intersection of Grove Street and Pine Avenue, where existing sidewalks to the West and North end.
2. The petitioner shall enter into a Reimbursement Agreement with the Village, agreeing to pay for the cost of sidewalks if installed at a future date.
Recommendation: In order to move the petition forward, the Staff Development Committee recommends the following:

A motion to recommend to the Village Board of Trustees, approval of the proposed 419 S. Pine Avenue Subdivision to create two lots, as well as a variation from Chapter 29 to waive the requirement for installation of sidewalks, subject to the following conditions:
1. Prior to issuance of a building permit for the new homes on each lot, impact fees shall be required in accordance with Chapter 29 of the Municipal Code.
2. A Design Commission application shall be required for each new home on the subject property.
3. Linkage fees, in accordance with Chapter 7 of the Municipal Code, shall be required prior to issuance of building permits for each new home on the subject property.
4. The petitioner shall continue to work with the Village on the final design and footprint of the homes.
5. Prior to issuance of a site development permit for the required improvements, the petitioner shall provide a fee-in-lieu of onsite detention.
6. The petitioner shall comply with all Federal, State, and Village Codes, Regulations, and Policies.
7. For pedestrian safety, accessible sidewalk ramps shall be installed at the intersection of Grove Street and Pine Avenue, where existing sidewalks to the West and North end (Exhibit A).
8. The petitioner shall enter into a Reimbursement Agreement with the Village, agreeing to pay for the cost of sidewalks if installed at a future date.
