In April 2014, the Village Board adopted an Ordinance Prohibiting the Use of Groundwater as a Potable Water Supply by the Installation or Use of Potable Water Supply Wells or by any Other Method for the area at and around 202 E. Rand Road. The ordinance was submitted to the Illinois Environmental Protection Agency ("IEPA"). While similar ordinances have been approved by the IEPA in the past, the IEPA has now decided that a radius map (which was attached to the original ordinance), is no longer acceptable. Instead, the IEPA requires a map with PINS of all affected properties. The attached ordinance is the same in substance as what was approved last year - only the exhibits were changed in order to comply with the IEPA's new requirements.
Recommendation
It is recommended that the Village Board adopt the attached Ordinance Prohibiting the Use of Groundwater as a Potable Water Supply by the Installation or Use of Potable Water Supply Wells or by any Other Method for the property at and around 202 E. Rand Road.
