Due to a clerical error, the Final Plat of Subdivision for Northwest Crossings was recorded before it was supposed to have been recorded. There is a condition in the Resolution approving the Final Plat that required the Reciprocal Easement Agreement (REA) be recorded within 60 days of the Final Plat being recorded or the approval of the Final Plat would be null and void. Due to the aforementioned error, the Final Plat was recorded but the REA was not ready to be recorded within 60 days. Accordingly, the original approval is null and void and the Final Plat must be approved again.

The Petitioner will be recording the Final Plat and then the REA in accordance with the time frames set forth in the Resolution.

RECOMMENDATION

It is recommended that the Village Board approve the attached Resolution.
