BACKGROUND

Carlos and Carlos Ristorante, located at 27 W. Campbell Street, has submitted an application to renew their outdoor dining space within a portion of Harmony Park adjacent to their restaurant at the northeast corner of the park.

Chapter 28, Section 5.1-14.2 allows the use of public sidewalks for outdoor eating cafes subject to certain criteria.  Because this request is to use public space in Harmony Park, a license agreement and approval by the Village Board is required.  The agreement includes conditions that require the removal of the outdoor dining during larger special events.  In the past, the agreement was a one year license - the proposed agreement is for three years.

The request from Carlos and Carlos is in accordance with the more relaxed requirements approved by the Village Board in May, 2014.  Carlos and Carlos is delineating the area through the use of planters and fencing.  The application has been reviewed by the appropriate departments and meets all requirements.  Carlos and Carlos has provided the appropriate insurance provisions and signed the License Agreement.

The proposal is consistent with the reduced area and use restrictions approved. 

RECOMMENDATION

It is recommended that the Village Board approve the attached Resolution Approving a License Agreement for three year for Carlos and Carlos' outdoor dining request.
