At the September 18, 2012 closed session, the Village Board authorized settlement of the workers' compensation claim for Firefighter Lawrence Brown. On February 29, 2009, Mr. Brown alleged that, while working as a firefighter, he developed obstructive pulmonary disease. Mr. Brown's claim was filed under the rebuttable presumption clause of the Illinois Worker's Compensation Commission, which essentially provides that any lung or respiratory disease is presumed to arise out of a firefighter's employment.
The settlement amount of $116,326 falls within the authorization previously granted by the Board.
Recommendation
It is recommended that the Village Board approve the worker's compensation settlement for Lawrence Brown in the amount of $116,326.
