Requested Action

 

1. Amendment to Planned Unit Development (PUD) Ordinances 98-061, 99-028, and 13-032 to allow certain changes to the approved floor plan for the Metropolis Mixed Use Development.

 

2. A Special Use Permit to allow a 3,974 sq. ft. restaurant and auditorium space (music venue). 

 

Variations Required

 

A Variation from Chapter 28, Section 6.12-1, to waive the requirement for a traffic and parking study prepared by a qualified professional engineer.

 

Project Update

 

As outlined in the Staff Development report dated November 3, 2017, several issues regarding handicap accessibility and compliance with the State Illinois Accessibility code need to be resolved and the floor plans modified.  

Since the Plan Commission hearing, the petitioner and the Building Department have continued to meet to discuss a resolution to the ADA washroom and ADA access to the stage.  Revised floor plans were submitted earlier this week, which have been reviewed by the Building Department and are getting closer to compliance with the accessibility code.  

The petitioner has indicated that they will make further modifications in order to meet these requirements.  Therefore, this matter has been placed on the Board agenda for consideration, subject to compliance with the outstanding ADA issues and submittal of revised floor plans prior to ordinance adoption should the Board recommend approval of the project. 

Recommendation

 

A public hearing was held by the Plan Commission on November 8, 2017 where Commissioner Green moved and Commissioner Cherwin seconded:

 

A motion to recommend approval to the Village Board of Trustees of PC#17-011, an amendment to PUD Ordinance c #98-061, 99-028, and 13-032 to allow certain changes to the approved floor plan for Metropolis mixed use development, a Special use permit to allow a 3,974 square foot restaurant and auditorium space (music venue), and the following variation:

 

1. Chapter 28, Section 6.12-1, to waive the requirement for a traffic and parking study prepared by a qualified professional engineer.

 

This approval shall be subject to the following conditions:

 

1.  All full time employees shall be required to purchase Employee Parking Permits for parking within the Village owned garage system.

 

2. No loud music shall be permitted to spill out into the street and neighborhood. Windows within the “venue” side of the establishment shall remain closed at all times during any paid admission show or any event with loud music.  Additional windows within the establishment shall be closed as necessary to prevent loud music from overflowing outside of the subject unit.

 

3. The petitioner shall install sound buffering material to reduce noise bleed into the Metropolis Ballroom space.

 

4. The Petitioner shall comply with all applicable Federal, State, and Village codes, regulations, and policies. 

 

In addition, the Petitioner understands that this approval is expressly conditioned upon providing a plan that complies with the Illinois Accessibility Code. If a Code-compliant plan is received and approved by Staff, the appropriate ordinance for this project will be presented to the Village Board for approval.
