Requested Action
Rezoning from the M-1, Research, Development, and Light Manufacturing District to the B-3, General Service, Wholesale, and Motor Vehicles District.
Variations Required
1. Chapter 28, Section 6.15-1.2(b), to waive the requirement for 4” shade trees within certain parking lot landscape islands.
2. Chapter 28, Section 6.15-1.2(a), to reduce the required height for parking lot landscape screening adjacent to a public way from 36-inches to 12-inches.
3. Chapter 28, Section 6.12-1, to waive the requirement for a traffic and parking study by a qualified professional engineer.
Recommendation
A public hearing was held by the Plan Commission on October 24, 2018 where Commissioner Jensen moved and Commissioner Cherwin seconded:
A motion to recommend approval to the Village Board of Trustees of PC#18-019, a Rezoning from the M-1 District to the B-3 District and the following variation:
- A variation to Chapter 28, Section 6.12-1, to waive the requirement for a traffic and parking study by a qualified professional engineer;
and denial of the other variations requested in PC#18-019 (which are outlined below), due to the fact that the Petitioner has not justified the variations based on the criteria for granting said variations:
1. Chapter 28, Section 6.15-1.2(B), to waive the requirement for four-inch shade trees within certain parking lot landscape islands.
2. Chapter 28, Section 6.15-1.2(A), to reduce the required height for parking lot landscape screening adjacent to a public way from 36-inches to 12-inches.
Approval shall be subject to the following conditions:
1. Outdoor storage of automobiles receiving any "major automobile repair" shall be prohibited.
2. The Petitioner shall comply with all Federal, State, and Village Codes, Regulations, and Policies.
Roll Call Vote: Commissioners Cherwin, Dawson, Green, Lorenzini, Jensen, and Chair Ennes voted in favor. Commissioner Drost voted against. Motion carried.
