Item: Ordinance - Code Amendment - Chapter 13 - Alcoholic Liquor Dealers

Pursuant to direction from the Village Board, the attached ordinance creates two new liquor license classifications. The first classification permits the retail sale of liquor at hotels at a retail location in the hotel and/or in-room mini-bars. Proof that the purchaser is a guest of the hotel is required before a sale can be made or the information to unlock an in-room cabinet is provided. Additionally, any liquor for sale at a retail location in a hotel must be accessible only to hotel staff or in a locked cabinet or cooler.

 

The second classification is for cosmetic facilities. That term is defined in the ordinance to include barbers, cosmetologists, and nail technicians. Cosmetic facilities may sell liquor only to customers while they are there for service. The license is limited to beer and wine only and no customer shall be served more than two servings per day.

 

For both new classifications, as with all other establishments selling or serving liquor, a manager as well as any employee who sells or serves must be BASSET certified. Dram shop (Liquor Liability) insurance is also required.

 

The proposed cost for each of these licenses is $1,400, which is the same cost as a license for a Coffee Shop. Staff felt that these uses were most like Coffee Shops, in that alcohol is truly incidental to the primary business use of both hotels and cosmetic facilities. Staff is proposing that if a hotel only sells liquor one way – retail or in-room – but not both, the cost of the license be $1,000.

 

Recommendation

It is recommended that the Village Board approve the attached Ordinance Amending Chapter 13 of the Arlington Heights Municipal Code to create two new liquor license classifications.
